These Terms of Service govern your use of ministryofvisualaffairs.co (the "Site"). The Site is operated by Velvet Collective, LLC, a Utah limited liability company doing business as Ministry of Visual Affairs ("MVA," "we," "us"). By using the Site you agree to these terms. If you do not agree, please do not use the Site.
1. What the Site is for
The Site presents MVA's studio, services and past work, and lets you get in touch with us. Nothing on the Site is an offer to provide services. Any design, branding or procurement work we do is governed only by a separate written agreement signed by both parties. If that agreement conflicts with these terms, the agreement controls.
2. Design information only
Content on the Site, including project descriptions, images, articles and product references, is shared for general information and inspiration. MVA provides aesthetic and design intent services. We do not provide architectural, engineering, life safety, MEP or building code compliance services, and nothing on the Site is professional advice of that kind. Always consult a licensed professional for your specific project.
3. Our content and your use of it
The Site and everything on it, including text, photography, renderings, drawings, logos, the MVA name and the overall look of the Site, belong to MVA or to the clients, photographers and partners who have licensed it to us. They are protected by copyright, trademark and other laws.
- You may view the Site and share links to it for personal, non-commercial purposes.
- You may not copy, reproduce, republish, sell, or create derivative works from Site content, or use it to train machine learning models, without our written permission.
- Project images show work completed for our clients. Inclusion of a project does not mean the client endorses you or any third party.
4. Acceptable use
You agree not to:
- use the Site in a way that breaks any law or infringes anyone's rights;
- attempt to gain unauthorized access to the Site, its hosting, or any system or data connected to it;
- scrape, harvest or bulk download content or contact details;
- send spam, malware or misleading information through our forms; or
- interfere with the Site's operation or security.
5. Messages and submissions
When you contact us through the Site, you confirm the information you provide is accurate and that you have the right to share it. Please do not send confidential information until a written agreement is in place. Unless we agree otherwise in writing, ideas or materials you send us unsolicited are not confidential and we have no obligation regarding them. How we handle personal information is described in our Privacy Policy.
6. Third-party links and services
The Site links to third-party websites such as Instagram, LinkedIn and manufacturer pages. We do not control those sites and are not responsible for their content, products or privacy practices.
7. Disclaimers
The Site is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not promise the Site will be uninterrupted, error free or free of harmful components. Product names, finishes, dimensions and availability mentioned on the Site may change and should be confirmed with the manufacturer.
8. Limitation of liability
To the fullest extent permitted by law, MVA and its members, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or business opportunity, arising from or related to your use of the Site. Our total liability for any claim arising from your use of the Site is limited to one hundred US dollars (US $100). This section does not limit liability that cannot be limited under applicable law, and it does not change the terms of any signed services agreement.
9. Your responsibility
You agree to be responsible for, and to reimburse MVA for reasonable costs arising from, any third-party claim caused by your misuse of the Site or your violation of these terms.
10. Governing law and disputes
These terms are governed by the laws of the State of Utah, without regard to its conflict of law rules. Before starting any legal proceeding, you agree to contact us and try in good faith to resolve the matter informally, and then through mediation. Any proceeding that follows will be brought exclusively in the state or federal courts located in Salt Lake County, Utah, and you consent to their jurisdiction. The prevailing party is entitled to its reasonable attorney fees.
11. Changes
We may update these terms from time to time. The date at the top of this page shows when they were last changed. Continuing to use the Site after a change means you accept the updated terms.
12. General
If any part of these terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. These terms, together with our Privacy Policy, are the entire agreement between you and MVA about use of the Site.
